Gray v. McCance

The defendant, in a non-sworn answer, claimed the complainant previously filed a similar case, now pending, in which he responded fully and the injunction was dissolved. Soon after filing the answer, the defendant moved to dissolve the injunction and dismiss the bill, which the Court granted, leading to an erroneous decision. The defendant failed to provide evidence supporting his claims. The Circuit Court's decree was reversed and remanded. Illinois Report 14 Ill 343 is also part of this case.
